HRIA Case Study: Legal protection at risk - the cumulative impact of anti-terror legislation

This study of the impact of Dutch anti-terror legislation on human rights, performed by the Humanist Committee on Human Rights (HOM), reveals the legislation will have a negative impact on the rights and freedoms of Dutch citizens. The study looks at five seperate bills introduced progressively from the beginning of 2005 onwards. These bills were examined from a human rights perspective.

The study examines the compatibility of the (proposed) legislation with the following guarantees: conformity with the rule of law; forseeability for citizens; purpose limitation; necessity; proportionality; and adequate judicial control. It can be concluded that the proposed legislation is not in line with these guarantees on a significant number of points.
